Our Privacy Policy

This policy explains what personal information we collect about you, how we may use or disclose your personal information, and the steps we take to ensure that your personal information is kept secure. In this policy, "personal information" is any information or opinion, in any form, which identifies an individual or from which an individual's identity is apparent or can be reasonably ascertained.

By using this website and giving your information to us, you indicate your consent to us, and any other organisations, third party suppliers and agents we engage or employ from time to time, to collect and use your personal information in accordance with the terms set out in this policy.


What information do we collect?

We only collect personal information that is necessary for us to conduct our business and to assist us with complying with our own legal and regulatory obligations. In order to conduct our business and to provide you with services, we may collect personal information about you from our registration forms, website, telephone conversations, e-mails, social media interactions and other written and verbal communications. 
The kinds of personal information we collect and hold will depend upon the personal information you choose to disclose to us. We may, for example, keep a record of your name, date of birth, occupation, address, telephone numbers, e-mail address, social media addresses, banking details, previous purchases from us and interests. 

 

Section 1 - How is the information used?

At Sunlit Folk we take your personal data very seriously. When you purchase something from our store, as part of the buying and selling process, we collect the personal information you give us such as your name, address and email address. When you browse our store, we also automatically receive your computer’s internet protocol (IP) address in order to provide us with information that helps us learn about your browser and operating system. This information improves our website’s performance (i.e., how to best display on your browser or device).

Email marketing : With your permission, we may send you emails about our store, new products and other updates.

We respect your rights to privacy under the Privacy Act 1988 (Cth) (Privacy Act) and so in accordance with this Act, we are compliant with its requirements in respect of the collection, management and disclosure of your personal information.

We also uphold your rights to privacy if you are based in the European Union, in accordance with the General Data Protection Regulation (GDPR) (EU).  Your rights under the GDPR are listed below.

If you do not wish to provide personal information to us, then you do not have to do so.  However, this may affect your use of this Site or any products and services offered on it. You may revoke your consent at any time and have the right in detail to request details of the information we keep.

 

Section 2 - Information sharing

We understand the importance of keeping personal data secure and safe and only share limited personal data with companies (such as Australia Post) we need to in order to maintain our business. We only keep information for the sole purpose of fulfilling your orders and for our own records and what is deemed fair use in our business within the parameters of the law.

 

Section 3 – Consent

How do you get my consent? When you provide us with personal information to complete a transaction, verify your credit card, place an order, arrange for a delivery or return a purchase, we imply that you consent to our collecting it and using it for that specific reason only. If we ask for your personal information for a secondary reason, like marketing, we will either ask you directly for your expressed consent, or provide you with an opportunity to say no.

Section 4– Disclosure

In order to conduct our business, we may appoint other organisations to carry out activities on our behalf. These may include, for example, delivery organisations, third party suppliers and agents. These third parties may have access to information needed to perform their function but cannot use that information for other purposes.

We may disclose your personal information if we are required by law to do so or if you violate our Terms of Service.

Payment: If you choose a direct payment gateway to complete your purchase, then Stripe store your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted. All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, Mastercard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

 

Section 5 - Website hosting and payment privacy

Our store is hosted through Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products to you. Your data is stored through Shopify’s data storage, databases and the general Shopify application. Shopify stores your data on a secure server behind a firewall.

Section 6 – Third-party services

In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us. However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions. For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers. In particular, remember that certain providers may be located in or have facilities that are located a different jurisdiction than either you or us.

So if you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located. As an example, if you are located in Canada and your transaction is processed by a payment gateway located in the United States, then your personal information used in completing that transaction may be subject to disclosure under United States legislation, including the Patriot Act. Once you leave our store’s website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our website’s Terms of Service.

Section 7 – Security

We take the security of your personal information seriously. We take reasonable steps to ensure that your personal information is treated confidentially, kept secure and protected against unauthorised use and is maintained only for the purpose for which it is intended.
Please be aware that the internet is not a secure environment. If you use the internet to send us any information, including your email address, it is sent at your own risk.
Shopify states that it encrypts your credit card information using secure socket layer technology (SSL) and that it is stored with a AES-256 encryption. Although no method of transmission over the Internet or electronic storage is 100% secure, our understanding is that Shopify follows all PCI-DSS requirements and implements additional generally accepted industry standards.

  

Section 8 – Cookies

When you access our website, we may send a “cookie” (which is a small summary file containing a unique ID number) to your computer.  This enables us to recognise your computer and greet you each time you visit our website without bothering you with a request to register.  It also enables us to keep track of services you view so that, if you consent, we can send you news about those services.  We also use cookies to measure traffic patterns, to determine which areas of our website have been visited and to measure transaction patterns in the aggregate.

We use this to research our users’ habits so that we can improve our online services.  Our cookies do not collect personal information.  If you do not wish to receive cookies, you can set your browser so that your computer does not accept them.  We may log IP addresses (that is, the electronic addresses of computers connected to the Internet) to analyse trends, administer the website, track users’ movements, and gather broad demographic information.
Most browsers automatically accept cookies, but you can usually change your browser to prevent cookies being stored. 
Please note, if you do turn cookies off this may limit the service that we are able to provide to you. We do not store any information that identifies you inside cookies.
